• Scope of personal data processing

  In principle, anyone can use our website without providing any personal data. We process personal data only to the degree that this is necessary to provide a functional website and our content and services. We regularly process personal data of our readers only after their consent. An exception applies in those cases in which obtaining prior consent is not possible for factual reasons and the processing of the data is permitted by legal regulations.

• Legal basis for processing personal data

  If we obtain the consent of the data subject for the processing of personal data, softdevel acts in accordance with Art. 6 para. 1a DSGVO. If softdevel processes personal data in order to fulfill a contract to which the data subject is a party, Article 6 (1b) DSGVO serves as the legal basis. This also applies to processes that are necessary for the implementation of pre-contractual measures. Insofar as the processing of personal data is necessary for compliance with a legal obligation to which softdevel is subject, we rely on Art. 6 (1c) DSGVO as the legal basis. In the event that vital interests of the data subject or another natural person require the processing of personal data, softdevel may rely on Art. 6 (1d) DSGVO as the legal basis. If the processing is necessary to protect a legitimate interest of our company or a third party and the interests, fundamental rights and freedoms of the data subject do not outweigh the former interest, softdevel shall act in accordance with Art. 6 (1f) DSGVO.

• Data deletion and storage duration

  softdevel deletes or blocks the personal data of the data subject as soon as the purpose of the storage ceases to apply. We also store data for as long as we are required to do so by law or regulation. We also block or delete personal data when a retention period prescribed by law expires, unless we need to continue storing the data for the conclusion or fulfillment of a contract.

• Technical and organizational measures

  softdevel protects personal data by technical and organizational security measures in order to minimize risks related to its loss, misuse, unauthorized access, unauthorized disclosure and alteration (Art. 32 DSGVO). For example, firewalls and data encryption, physical access restrictions for the company's own systems and authorization controls for data access are used for this purpose.

• Cooperation with processors and third parties

  Insofar as softdevel discloses data to other persons and companies (order processors or third parties) in the course of processing, transmits it to them or otherwise grants them access to the data, this is done exclusively on the basis of legal permission or consent. If softdevel has data processed, this is done in each case on the basis of a contract processing agreement (Art. 28 DSGVO).

• Transfer of data to third countries

  A transfer of personal data to a third country outside the European Economic Area (EWR) only takes place if we inform our users about it and the prerequisite of Art. 44 et seq. DSGVO are given. We inform our users in this privacy information when and how we transfer personal data to the USA or other third countries. A transfer will only take place if sufficient guarantees are provided by the recipient in accordance with Article 46 of the DSGVO for the protection of the personal data, the user has expressly consented to the transfer, the transfer is necessary for the fulfillment of contractual obligations or another exception from Article 49 of the DSGVO applies. Guarantees according to Art. 46 DSGVO can be so-called EU standard contractual clauses. In it, the recipient assures to sufficiently protect the data and thus to ensure a level of protection comparable to the DSGVO.

• Description and scope of data processing

  When you visit our website, we or our hosting provider automatically store data and information from the computer system of the requesting computer by default.

  The following data will be collected:

  • Information about the browser type and version used
  • the operating system of the user
  • IP address
  • Date, time and duration of the visit
  • Websites from which the user's system accesses our website
  • Websites that are called up by the user's system via our website

  The data is also stored in the log files or databases of our system. We do not store this data together with other personal data of the user.

  To protect the security of the data during transmission, we use state-of-the-art encryption methods such as SSL via HTTPS.

• Legal basis and purpose of data processing

  The legal basis for the temporary storage of the data and the log files is Art. 6 para. 1f DSGVO.

  The temporary storage of the IP address by the system is necessary so that we can deliver the website to the user's computer. For this purpose, the user's IP address must remain stored for the duration of the session.

  The storage in log files is done to ensure the functionality of the website. In addition, we use the data to optimize the website and to secure our information technology systems. The storage also takes place so that we can provide the authorities with the information necessary for law enforcement in the event of an attack on our site.

  We evaluate the anonymously collected data and information statistically, and moreover, with the aim of increasing data security, so that we can ultimately ensure an optimal level of protection for the personal data we process.

  An evaluation of the data for marketing purposes does not take place. These purposes are also our legitimate interest in data processing according to Art. 6 para. 1f DSGVO.

• Duration of storage, right of objection

  softdevel deletes the data as soon as they are no longer required for IT security purposes. In the case of the collection of data for the provision of the website, this is the case when the respective session of the reader has ended. Beyond that, we only store your usage data to fulfill any legal retention periods. We delete the data stored in log files after 90 days at the latest. The collection of data to provide the website and the storage of data in log files is necessary for the operation of our website. The user has a right of objection according to Art. 21 para. 1 DSGVO. softdevel shall no longer process the personal data unless we can demonstrate compelling legitimate grounds for the processing which override the interests, rights and freedoms of the data subject, or for the establishment, exercise or defence of legal claims. • Cookies

  Cookies are small text files that can be stored temporarily in the Internet browser or by the Internet browser on the user's computer system when a website is called up or after consent has been given. Cookies contain a characteristic string of characters that allow the browser to be uniquely identified when the website is called up again.

  We use on our website, with the exception of the necessary, i.e. absolutely necessary cookies, only those to which the user has given his consent.

We use analysis services to constantly improve our website and make it more user-friendly - but only with the express consent of the user. We have compiled the services we use below.

Google Analytics

softdevel uses Google Analytics, a web analytics service provided by Google Ireland Limited ("Google"), Gordon House, Barrow Street, Dublin 4, Ireland.

Scope of data collection

No Google Analytics cookies are set without the express consent of the user. After consent via the Consent Manager we use, Google Analytics uses so-called cookies, text files that are stored on the user's computer. Google will use this information for the purpose of evaluating your use of the website on our behalf and compiling reports on website activity. For this purpose, we have concluded an order processing contract with Google (Art. 28 DSGVO). This information may be transferred to a Google server in the USA and stored there. To ensure a sufficient level of protection, Google uses standard contractual clauses designed to ensure that data is protected in a manner comparable to that in Europe. These clauses are based on a decision by the EU Commission.

Google may also transfer this information to third parties where required to do so by law, or where such third parties process the information on Google's behalf. Google will not associate a user's IP address with any other data held by Google. IP addresses are only processed in abbreviated form in order to exclude a direct reference to a person.

The softdevel website contains contact details that enable us to be contacted quickly and electronically and to communicate directly with us.

Scope of data processing

If you contact us by email, the personal data you provide will automatically be stored for processing or for contacting you. This personal data is not passed on to third parties. The data will be used exclusively for processing the communication.

Legal basis and purpose of processing

The legal basis for the processing of the data is Art. 6 (1a) DSGVO if the user has given his consent. The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6 (1f) DSGVO. If the e-mail contact aims at the conclusion of a contract, the additional legal basis for the processing is Art. 6 (1b) DSGVO. In the case of contact by e-mail, the necessary legitimate interest in processing the data lies in ensuring communication.

Storage period, right of revocation and objection

The data is deleted as soon as it is no longer required to achieve the purpose for which it was collected. For personal data sent by e-mail, this is the case when the respective conversation with the user has ended. The conversation is ended when the circumstances indicate that the matter in question has been conclusively clarified. You have the possibility to revoke your consent to the processing of personal data at any time. You can also object to the storage of your personal data at any time for the future. In such a case, communication cannot continue. You can send an email to privacy@sillysky.de to do so. All personal data stored in the course of contacting us will be deleted in this case.

softdevel provides its users with an online forum. In this forum our readers can ask their questions, meet other readers and exchange ideas.

Scope of data processing

Anyone who registers can become a member of the softdevel community. In the registration form we collect the following data: Username, which the user can give himself, e-mail address, password. The user agrees that the stored master data may be used for the individual creation and sending of selected information by e-mail. We also use cookies: when logging in, the user's access data is stored in encrypted form in order to be able to log him in automatically when the page is called up at a later time. In the login window, the user can use the "Stay logged in permanently" option to specify whether these cookies should be created. The first time our site is accessed, a new session is started, this is assigned to the user's computer by a unique cookie. The cookies allow to recognize the user between two page views and to provide him with all functionalities. This is a temporary cookie that is automatically deleted when you exit the Internet browser.

Legal basis and purpose of data storage

softdevel stores the personal data provided by the user during registration on the basis of Art. 6 para. 1a DSGVO according to the user's consent. The user of the community also agrees to the use of cookies. Furthermore, they are also necessary in the sense of Art. 6 para. 1f DSGVO. With the security query via recaptcha, we ensure that the registration is made by a real person and not automated, e.g. by software (so-called robots). There is a legitimate interest according to § 6 para. 1f DSGVO.

Objection and data subject rights

The user is entitled to revoke his consent to the storage of his personal data at any time for the future. All you need to do is send an e-mail to the forum moderators: privacy@sillysky.net. Forum posts will still remain.
